The Funeral of a Sinner (FATWA)

The Question

What do the scholars of the religion say in the following issue:

Is it permissible or not to have a funeral for such an individual who sometimes prays ṣalāh and sometimes does not?

Furthermore, is the funeral of the non-bāligh son of the one who does not pray ṣalāh permissible or not?

The Answer

Even though one who does not pray ṣalāh is a fāsiq, he is still a Muslim. Also, the ritual bath, shrouding, ṣalāh and burial of his immature child has the same ruling as any other Muslim. It has been stated in a Ḥadīth:

صلوا على كل بَرّ وفاجر

Pray upon all righteous and corrupt.

Allāh E knows best.
